1. Acceptance of Terms

By creating an account, accessing, or using VistRank, you agree to be bound by these Terms of Service. If you do not agree to every provision of these Terms, you may not use the Service.

2. Description of Service & Etsy Disclaimer

VistRank is an independent AI-powered optimization tool designed to assist sellers. VistRank is NOT affiliated with, endorsed by, or sponsored by Etsy, Inc. The term 'Etsy' is a trademark of Etsy, Inc. Our service generates titles, tags, descriptions, and pricing recommendations based on your uploads.

3. No Guarantee of Sales or Rankings

While VistRank utilizes advanced AI to optimize your listings, we make no guarantees, warranties, or promises regarding improved search visibility, increased traffic, or enhanced sales on Etsy. The Etsy search algorithm is proprietary and changes frequently.

4. Subscriptions, Payments, and Cancellations

Paid subscriptions are billed on a recurring monthly basis through PayPal. By subscribing, you authorize us to charge your payment method automatically. You may cancel your subscription at any time through your dashboard; you will retain access until the end of the current billing cycle. We do not offer prorated refunds.

5. User Responsibilities & Acceptable Use

You are solely responsible for checking all AI-generated content before publishing it to your shop. You agree not to upload explicit, illegal, or copyrighted images that you do not have permission to use. Attempting to reverse-engineer, mass-scrape our API, or exploit potential bugs will result in immediate permanent account termination.

6. Intellectual Property & License

You retain all rights to the original product images you upload. By uploading them, you grant VistRank a temporary license to process them via our AI models purely to provide the Service to you. The resulting AI-generated text and metadata are yours to use commercially.

7. AI Data Processing

To provide the Service, VistRank analyzes your uploaded images and text using our advanced artificial intelligence algorithms. Your data is processed securely and is strictly protected. We do not use your private images to train our machine learning models.

8. Limitation of Liability

VistRank and its creators shall not be liable for any indirect, incidental, or consequential damages, lost profits, or shop suspensions resulting from the use of our Service. Your exclusive remedy for any claim is to stop using the Service. Our total liability shall not exceed the amount you paid us in the trailing 3 months.

9. Modifications to Terms

We reserve the right to modify these terms at any time. Significant changes will be communicated via email or an in-app notice. Continued use of VistRank constitutes acceptance of the modified Terms.
